Social Media Giants Struggle Against Ongoing User Addiction Lawsuits Following Unsuccessful Appeals

Tech giants such as Meta, TikTok, Snapchat, and Google are bracing for extensive legal battles related to allegations of intentionally creating addictive features aimed at minors.

A recent report highlighted that the 9th U.S. Circuit Court of Appeals in San Francisco rejected these companies’ attempts to dismiss numerous lawsuits by invoking Section 230. This section typically shields platforms from responsibility for user-generated content. The firms contended that this provision should also defend them from accusations regarding the lack of warnings about the addictive nature of their designs. However, the court suggested that their appeal might be premature, noting that such appeals are often considered after a trial concludes.

These lawsuits, which include claims from individuals, state and local authorities, and school districts, have been merged into a single federal case that will move forward collectively.

While it remains uncertain how these cases concerning addictive design will unfold, Meta has already faced unfavorable outcomes in two lawsuits regarding similar matters, making it the first instance where the company has been found liable in jury trials concerning child safety issues.
